  • Application Procedure

              New Lease


    To apply to lease one of our commercial properties you must first view it and then provide the following documents :


    Application Form fully completed and signed


    Photo ID, this a legal obligation under Money Laundering - Proceeds of Crime Act 2002. This is usually a passport or driving license.


    Proof of current address. You must provide an official document with your name and current address on. The best documents for this are a driving license, a recent utility or Council Tax bill (no older than 3 months) or a current Tenancy Agreement. Please note that if you use your driving license as proof of address you must supply another form of identification.


    3 months of bank statements. If applicable please provide both personal and business bank statements. 


    EITHER 

    Most recent year end accounts, if you are already in business and if available a business plan or any other information in support of your application


    OR 

    Business plan, if you are setting up a new business. This should include information about your business and cash flow

    If you do not have all these documents or are unsure, please contact us before you submit your application. Your application will only be considered once all of these documents have been provided.


    Please ensure that you send high quality copies of these documents, your documents will not be accepted if they are not clear. The best format is online copies or scans. You can usually scan documents with your phone.



              Lease Assignment 


    You must provide the same information as above.


    If you are purchasing the current business at the property, please fill in the new business section of the application form for yourself as well as the current business section if you have these details. 


    If you are starting a new business in the premises, please complete the new business section of the application form.

  • Starting Your Tenancy

    Once your application has been received it will then be reviewed, this may take up to two weeks. We will contact you if we require any further documents. We will seek landlord’s approval, do a credit check and references gained.


              New Lease


    If you are offered one of our leases, we will contact you to arrange a sign-up date. 

    On your sign up you will be required to come to our office with your original ID where a payment of the first payment of rent and the lease fee is required by cash or card. If you by BACs you must ensure payment has been received before your sign-up appointment.

    Once the lease has been signed and witnessed and the monies have been received, we will issue the keys. Your payments of rent will then be due on the same day of each month of the tenancy commencement date.

    If you have requested and are offered a longer lease that requires solicitors, we will confirm the landlord’s approval of your application to you and the landlord’s solicitors will then contact you and your solicitors. 


              Lease Assignment


    If the landlord approves the assignment to you, we will contact you to arrange a sign-up date. Both you and the current tenant will be required to come to our office with your original ID to sign the surrender and assignment documents/ new lease. 


    Payment of the first payment of rent and the assignment fee is required by cash or card. If you by BACs you must ensure payment has been received before your sign-up appointment.


    If solicitors are being used, we will confirm the landlord’s approval of your application to you and the landlord’s solicitors will then contact you and your solicitors.

  • Lease Terms

              New Lease


    Handley Gibson offers 3 year standard leases. Longer leases require solicitors to negotiate. If you request a lease longer than 3 years you will need to instruct a solicitor to act on your behalf and give us their details to pass onto the landlords solicitors. 


    You will be responsible for the costs in preparing these leases. 


    All leases are offered on an annual rent, payment of the rent is usually accepted in monthly instalments but may be requested in quarterly instalments.

     

    The building is insured by landlord and the premium recovered from tenant annually. 


    All leases are effectively fully repairing and insuring terms unless specified otherwise. 


              Lease Assignment


    To take over a lease from one of our current tenants, you must first ensure we have received written notice of this intention from the current tenant. Landlords’ approval will need to be sort and you will be responsible for their legal and surveying costs relating to the assignment.


    If there is a long enough term left on the lease you will sign an assignment document to take over the terms of the current lease. If the current lease has expired or only has a short term left, you would be offered a new lease. In this case the above regarding new leases applies. 


    In some cases, the landlord may offer the assignment on the condition of a rent increase. 


    If solicitors were used for the original lease, they would have to be used for the assignment unless a new lease is offered. 

  • Data Protection Policy

    Handley Gibson are committed to keeping your personal details secure, and we will not give your details out to third party companies except as required to carry out our normal duties and liaise with subcontractors. In accordance with the UK General Data Protection Regulations (GDPR) the data controller is Handley Gibson Ltd of Scott Hall House, Sheepscar Street North, Leeds, LS7 3AF.


     Your personal details including telephone numbers, email address etc are all protected by law under the UK GDPR and we will take reasonable precautions to comply with these privacy rules.

        You will be required to submit personal and financial details prior to us taking up references. In applying for your tenancy (and signing this document), you agree to us passing on these details to a credit reference agency or to your nominated referees for referencing purposes. As agents, we act for our client landlords, and so this information may also be passed on to the Landlord of your property as required.

        During the management of your tenancy, we may be required to pass on your contact details to our subcontractors, utility companies and other related parties for example to arrange access to carry out maintenance on your heating system or to ensure that you are correctly billed for services used.

        Where there are rent arrears or other charges remaining at the end of the tenancy, we reserve the right to pass on your details to a tracing agent or debt collection company to help recover the money owed to us. Leaving unpaid rent and other bills at the end of your tenancy may affect your credit rating, and your ability to obtain a new tenancy, or other credit facilities.



    Handley Gibson is a responsible data collector and will process any personal data in accordance with the required data protection rules. We will not pass on your personal details to any external organisation for marketing purposes without your written permission.

          New Lease
